Following direct feedback from food truck operators who shared that certain city regulations made it difficult to operate locally, the city reviewed its existing requirements, conducted a study of mobile food vending regulations, and considered best practices from neighboring municipalities to identify opportunities to improve the city’s regulations and proposed Ordinance 2798. The proposed changes were presented to City Council, which approved the updated ordinance on Monday, Oct. 19. The updated regulations reduce certain restrictions on where food trucks can operate while maintaining provisions intended to address residential and school-related concerns.

Changes made in Ordinance 2798:

  • More flexibility near residential properties: The minimum distance from a residential dwelling was reduced from 100 feet to 50 feet at all times. However, food trucks must still remain at least 300 feet from a residential dwelling between 9 p.m. and 7 a.m., unless a permit allows otherwise.
  • Fewer restrictions near other businesses: The previous requirement prohibiting food trucks from operating within 175 feet of a business selling prepared food while that business was open has been eliminated.
  • Updated school requirements: The previous 300-foot restriction near schools during school hours has been replaced with a requirement for food truck operators to obtain prior written permission from an authorized school representative before operating in proximity to a school. Operators must keep an original copy of that permission available for inspection.

These changes reflect the city's commitment to listening to residents and business owners and finding practical ways to support economic opportunity in Commerce City. Feedback from food truck operators helped identify where the previous regulations created challenges. Commerce City recognizes the important role small businesses and entrepreneurs play in contributing to a vibrant local economy. The city will continue looking for opportunities to improve processes, reduce unnecessary barriers, and make it easier for businesses to grow and succeed in the community.
